The Promotion begins November 18^th, 2024 at 12:00 a.m. Mountain  Time (“MT”) and ends December 8^th, 2024 at 12:00 a.m. MT (“Promotion Period”).

Eligibility: Promotion is open to residents of the State of Arizona, who are at least 18 years of age. Employees, officers, and directors of AT&T Mobility LLC (“Sponsor”) and their employees, participating radio stations, Trade Marketing & Promotion Group, Inc. (DBA “TMPG”, hereafter “TMPG”  or “Administrator”) and their respective parent companies, subsidiaries, affiliates, promotion and advertising agencies, other companies involved in the design, execution or fulfillment of this Promotion, and members of the immediate families (defined as including spouse, biological, adoptive and step-parents, grandparents, siblings, children and grandchildren, and each of their respective spouses, regardless of where they reside) and persons living in the same household (whether related or not) of any of the above, are not eligible to enter or win. Void outside the State of Arizona and where prohibited by law.  Promotion is subject to all applicable federal, state and local laws. By participating, you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor and Administrator, which are final and binding on all matters relating to this Promotion.

How to Enter: During the Promotion Period, visit www.attphoenix.com (the “Web site”) and follow the links and instructions to complete the  official entry form with all required information including your Fan Favorite Phoenix memories or what you love about Phoenix, written in English only. Non-compliant stories will be disqualified.

All entries become the sole property of the Sponsor and will not be returned. Receipt of entries will not be acknowledged.

There is a limit of a maximum of one (1) entry per person throughout the entire Sweepstakes Period. Multiple entries received from any person or e-mail address in excess of the limitation stated above will be void. However, should Sponsor or Administrator determine that a given person has engaged in egregious or repeated violations of the entry limit, such person will be disqualified from the Promotion altogether, with all of his/her entries being void. All entries submitted in compliance with these Official Rules and not disqualified are considered “Eligible Entries”.

Any attempt by any individual to exceed the above-indicated entry limit by using multiple/different e-mail, postal addresses, identities, or any other methods will void all that individual’s entries and that individual will be disqualified. Use of any automated program or like means to submit an entry will result in disqualification. Proof of transmission of an entry does not constitute proof of entry or proof of receipt of entry by Sponsor. In the event of dispute as to the identity or eligibility of a potential winner, the winning entry will be declared made by the person named on the entry form , provided he/she is eligible according to these Official Rules.

Sponsor, TMPG and their respective agencies are not responsible for late, lost, garbled/illegible, misdirected, incomplete, or invalid entries, all of which are void and will not result in Sweepstakes entry.

Entry will be automatically disqualified if Sponsor or TMPG determines in their sole discretion that content of Fan Favorite Phoenix memories or what you love about Phoenix  is libelous, defamatory, obscene, abusive, offensive, includes any material protected by copyright, trademark or other proprietary right without the express permission of its owner, is inappropriate for inclusion in the Sweepstakes for any reason, or is otherwise  in violation of the “Unauthorized Activities” section of the Terms of Use of the Web site, which are available at www.attphoenix.com and are incorporated  herein by reference. Entrant must have permission to include any reference to any other person in his/her entry; proof of permission may be required at any time.

In submitting entry, entrant represents and warrants that the Fan Favorite Phoenix memories or what you love about Phoenix story therein: (1) is solely his/her original work product; (2) has not been entered into previous contests or sweepstakes and has not won previous awards; and (3) will not infringe or violate the rights of any third parties, including but not limited to copyrights, trademarks or rights of publicity/privacy. Entrant further agrees to release, indemnify and hold Sponsor and TMPG harmless from and against any claims to the contrary.

In submitting entry, entrant understands and agrees that the Fan Favorite Phoenix memories or what you love about Phoenix story is a “Submission” as defined in the “Material You Submit” section of the Terms of Use of the Web site and, as such, entrant grants to Sponsor a non-exclusive, perpetual, irrevocable, royalty-free, fully paid-up, worldwide license to same.  The Terms of Use of the Web site are available via the link above, and are incorporated herein by reference.

Sponsor may, but is not obligated to, post any Fan Favorite Phoenix memories or what you love about Phoenix storyon the Web site or any other of its web sites, or on its social media pages. Such posting  does not indicate that the entrant who submitted the story has won the prize. For clarity, while an entrant MUST include their  Fan Favorite Phoenix memories or what you love about Phoenix story as part of their entry, the content of the Fan Favorite Phoenix memories or what you love about Phoenix story will NOT be taken into account in the winner selection procedure provided that the content of the Fan Favorite Phoenix memories or what you love about Phoenix story is in full compliance with these Official Rules.

ANY POSTED FAN FAVORITE PHOENIX MEMORIES OR WHAT YOU LOVE ABOUT PHOENIX STORY REPRESENTS SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL ENTRANT AND DOES NOT REFLECT THE VIEWS/OPINIONS OF THE SPONSOR OR TMPG IN ANY MANNER.

Grant of Rights to Sponsor: Submitting Fan Favorite Phoenix memories or what you love about Phoenix story as part of entry constitutes entrant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display the entry in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes without limitation and without further notice or approval. If requested, entrant must sign upon request and without compensation any documentation that may be reasonably required for Sponsor to make use of the non-exclusive rights entrant is granting herein.  Each entrant agrees that the products of such use, if any, shall become the property of Sponsor and/or Sponsor’s licensees, and shall be freely assignable by Sponsor and its licensees. Entrant further agrees that he/she will not be paid or compensated for any such use of his/her entry by Sponsor or its designees, and further waives any “Moral Right of Authors” (Droit Moral) in the entry.

By submitting Fan Favorite Phoenix memories or what you love about Phoenix story as part of an entry, each entrant acknowledges that such submission is gratuitous, unsolicited, and without restriction, and will not place Sponsor under any obligations other than those contained in these Official Rules, and that Sponsor is free to disclose the information contained in the entry on a non-confidential basis to anyone or otherwise use the ideas therein without any compensation to the entrant. Each entrant further acknowledges that the Sponsor does not waive any rights to use similar or related ideas previously known to the Sponsor, or developed by its employees, or obtained from sources other than the entrant. Each entrant agrees that he/she will not instigate, support, maintain, or authorize any action or lawsuit against Sponsor on the basis that any use of his/her entry infringes any of his/her rights as creator of the entry.

Collection of Personal Information Sponsor, TMPG, and their agencies collect personal information from you when you participate in the Promotion. The information collected is subject to the AT&T’s Privacy Policy at https://about.att.com/privacy.html. This sweepstakes may be considered a financial incentive under state privacy laws. For example, you may be entered into the sweepstakes when you provide certain personal information to us, including your contact information and your survey responses.  The personal information provided will be collected, used, and disclosed in accordance with the AT&T Privacy Notice. By registering for and participating in the sweepstakes, you are opting in to potentially receiving the financial incentive. You may opt-out of the financial incentive at any time by cancelling your participation in the Sweepstakes or not providing your personal information.  The financial incentive related to submission and use of personal information is based upon our reasonable good faith estimate of the value of such information, which takes into consideration various factors such as anticipated revenue generated, anticipated expenses incurred for the collection, storage, and use of such information, and other relevant factors related to the estimated value of such personal information to our business.

The winner will be selected in a random drawing which will be conducted by Administrator on or about December 9th, 2024. The random drawing will consist of all eligible entries received.

Prize, Odds of Winning and Winner Notification: Only one (1) prize will be awarded. Prize winner will receive one pair (2) Tickets to a Billie Eilish** concert the Phoenix area (Glendale) which will take place on December 13^th, 2024 Total Approximate Retail Value: $200.

Tickets are valid only for indicated concert on designated date and if winner is not available for concert on designated date, prize will be forfeited and an alternate winner may be selected (time permitting).

Concert is subject to availability and other restrictions.

Tickets are subject to terms/conditions indicated thereon, including policy if concert cannot be held as scheduled. Tickets are intended solely for use by winner and his/her guest; provision of tickets to another party via re-sale or otherwise is prohibited.  Ticket type and seat location will be determined by Sponsor in its sole discretion. Winner and guest must also comply with venue restrictions (e.g., attendee code of conduct including bag policy, security screening, prohibition on certain items, re-entry policy, and protocols designed to prevent the spread of COVID-19/Coronavirus, as applicable). If winner and/or guest are ejected from concert due to inappropriate conduct of any kind, Sponsor, TMPG and their agencies shall not have any liability of any kind and reserve the right to seek legal sanctions against winner and/or guest. If winner chooses to accept the prize without a guest, winner will only receive one (1) ticket to the concert and no substitute prize or compensation will be awarded.

Winner is solely responsible for any applicable federal, state, and local income taxes and all unspecified expenses or fees associated with prize acceptance, receipt and use (e.g., travel to/from venue hosting concert, parking at venue, meals and souvenirs). No substitution, assignment, or transfer of prize permitted, except by Sponsor, who reserves the right to substitute prize with another prize of equal value if advertised prize cannot be awarded as stated for any reason. Prize cannot be redeemed or exchanged for cash by winner.

In the event that the potential prize winner cannot be contacted, or prize is returned as undeliverable, potential winner forfeits prize without compensation. In the event that potential prize winner is disqualified for any reason, potential winner forfeits prize. In the event of prize forfeiture, an alternate winner will be selected in a random drawing from all remaining eligible entries received for the drawing (time permitting).

Odds of winning depend on the total number of eligible entries received.

General Conditions: Sponsor’s computer is the official clock for purposes of the Sweepstakes. Sponsor reserves the right to cancel or modify the Promotion if fraud, technical failures, or any other factor beyond its control impairs the integrity of the Promotion, as determined by Sponsor in its sole discretion. In such event, TMPG will select the winner via random drawing from among all eligible, non-suspect  entries received prior to (and/or after, if appropriate) the action taken by Sponsor or by some other means deemed by Sponsor/TMPG in their sole discretion to be fair, appropriate, and consistent with the spirit of these Official Rules. Notice of such action by Sponsor will be posted on attphoenix.com. Sponsor/TMPG reserve the right, in their sole discretion, to disqualify any individual they determine, in their sole discretion, to be tampering with the entry process or the operation of this Promotion or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to deliberately damage the website or undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, Sponsor and TMPG each reserve the right to seek damages from any such person to the fullest extent permitted by law (as well as disqualifying such individual, if appropriate). Sponsor’s/TMPG’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. These Official Rules (or any other Sweepstakes materials) may not be published elsewhere without the express written consent of Sponsor, which may be withheld for any reason.

 

Publicity Release: Except where prohibited by law, participation in the Promotion and acceptance of prize constitutes winner’s consent to Sponsor’s and its designees’ use of winner’s name, likeness, voice, opinions, hometown, and state and other indicia of persona for promotional, trade, or advertising purposes in commerce and in any media without geographic or time limitation, and without additional payment, notice or consideration.

 

Liability Release: By entering, entrant agrees to release and hold harmless Sponsor, its parent company, affiliates, Promotion partners and agencies, Administrator, radio station partners, Meta Platforms, Inc. and each of their respective officers, directors, employees, and agents (collectively, “Released Parties”), from and against any claim or cause of action arising out of participation in the Promotion or receipt or use or misuse of the prize (if applicable).

 

Limitations of Liability: You hereby agree that the Released Parties are not responsible for, and you hereby release and hold harmless the Released Parties from and against, any claims arising from: (a) incorrect or inaccurate transcription of entry information or lost, stolen, illegible, incomplete, or misdirected entries, or entries  received through impermissible or illegitimate channels all of which are void and will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, mobile device,, computer, network, hardware, or software; (c) the unavailability or inaccessibility of any website or any other service; (d) unauthorized human intervention in any part of the entry process or the Promotion and/or incomplete or inaccurate information being displayed on Sponsor’s Web site whether due to unauthorized human intervention, equipment failure or malfunction, or other cause; (e) electronic or human error which may occur in the administration of the Promotion, announcement of the winner or the processing of submitted entries; or (f) any injury or damage to persons or property, including but not limited to an individual’s computer or mobile device (or any information/materials stored thereon), which may be caused, directly or indirectly, in whole or in part, by participation in the Promotion or from downloading any material from Sponsor’s or related website(s), regardless of whether the material was prepared by Sponsor, its agencies, or other third party, and regardless of whether the material is connected to Sponsor’s or its agency’s website by a hypertext link.

 

Disputes / Choice of Law: To the fullest extent permitted by law, you agree that: (a) any and all disputes, claims and causes of action arising out of or connected with this Promotion or the award of the prize  shall be resolved individually, without resort to any form of class action, and exclusively by a court of competent jurisdiction  in the State of New York; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (c) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, “Special Damages”), and  you hereby waive all rights to claim Special Damages and all rights to have such damages multiplied or increased.  The internal, substantive law of New York governs the Promotion and all aspects related thereto including construction, validity, interpretation, and enforceability of these Official Rules.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials or made by any of the Released Parties, and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.

The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
